1. Acceptance of Terms

By accessing or using HustleLink ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

HustleLink reserves the right to modify these terms at any time. We will notify users of material changes via email or through the Platform. Your continued use after changes constitutes acceptance of the modified terms.

2. Platform Description

HustleLink is a marketplace platform that enables sellers ("Sellers") to create storefronts and sell food, crafts, handmade goods, and other products directly to buyers ("Buyers"). We provide the technology infrastructure to facilitate these transactions but are not a party to any transaction between Sellers and Buyers.

3. Seller Responsibilities

As a Seller on HustleLink, you agree to:

  • Permits and Licenses: Obtain and maintain all necessary business licenses, permits, and certifications required by your local, state, and federal authorities to sell your products.
  • Food Safety: If selling food products, comply with all applicable food safety regulations, including California Cottage Food Law (AB 626) or equivalent regulations in your jurisdiction. You are solely responsible for food safety, proper labeling, allergen disclosure, and handling.
  • Taxes: Collect and remit all applicable sales taxes and report all income to appropriate tax authorities. HustleLink does not collect or remit taxes on your behalf.
  • Accurate Listings: Provide accurate descriptions, pricing, and availability information for all products.
  • Fulfillment: Fulfill orders in a timely manner as described in your storefront.

4. Buyer Responsibilities

As a Buyer on HustleLink, you agree to:

  • Provide accurate contact and payment information.
  • Be available to receive orders during agreed-upon pickup or delivery windows.
  • Review product descriptions, including allergen information, before purchasing.
  • Communicate directly with Sellers regarding any order issues.

5. Prohibited Items

The following items are strictly prohibited on HustleLink:

  • Raw meat, poultry, or seafood (unless properly licensed)
  • Alcohol or alcoholic beverages
  • Controlled substances, illegal drugs, or drug paraphernalia
  • Firearms, weapons, or ammunition
  • Counterfeit or stolen goods
  • Tobacco products or vaping supplies
  • Products that infringe on intellectual property rights
  • Any item prohibited by local, state, or federal law

6. Platform Fees

HustleLink charges a platform fee of [X]% on each completed transaction. This fee is automatically deducted from the transaction amount before funds are transferred to the Seller. Fees may be updated with 30 days' notice to Sellers.

7. Payment Processing

All payments are processed through Stripe, our third-party payment processor. By using HustleLink, you agree to Stripe's Terms of Service. HustleLink does not store full credit card information. Funds are typically transferred to Seller accounts within 2-7 business days after a completed transaction.

8. Account Termination

HustleLink reserves the right to suspend or terminate accounts that violate these Terms of Service, engage in fraudulent activity, receive multiple complaints from Buyers, or fail to respond to platform communications. We may terminate accounts at our sole discretion with or without notice.

9. Dispute Resolution

Disputes between Buyers and Sellers should first be resolved directly between the parties. If a resolution cannot be reached, you may contact HustleLink at support@hustlelink.app for mediation assistance. HustleLink's decision in any dispute shall be final and binding.

10. Limitation of Liability

HUSTLELINK IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUSTLELINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.

HustleLink is not responsible for the quality, safety, legality, or availability of any products sold on the Platform. We are not liable for any foodborne illness, allergic reactions, or other harm resulting from products purchased through the Platform.

11. Indemnification

You agree to indemnify and hold harmless HustleLink, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action arising from these terms shall be brought exclusively in the state or federal courts located in California.

13. Changes to Terms

We may modify these Terms of Service at any time. Material changes will be communicated to users via email or through the Platform at least 30 days before taking effect. Your continued use of the Platform after changes constitutes acceptance of the modified terms.
